Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you and RevGen Networks LLC, doing business as GotW3 ("GotW3," "we," "us," or "our"). By ordering, activating, or using any GotW3 service, device, or website, you agree to be bound by these Terms, our Privacy Policy, and our Fair Use Policy.

1. Services

GotW3 provides wireless 4G LTE broadband internet access through portable hotspot devices. Our services are designed to deliver reliable internet connectivity for residential and personal use. We do not guarantee minimum download speeds, upload speeds, or continuous connectivity due to environmental, network, and coverage factors. The speed you receive depends on your proximity to a network tower, network congestion, the number of devices connected, and other factors beyond our control.

2. Account and Eligibility

To use our services you must be at least 18 years of age and provide accurate, complete account information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

A correct email address must be on file to receive communications regarding firmware updates, SIM card replacements, and other internet-related communications from GotW3.

3. Pricing and Billing

Monthly Charges

Your first month of service, including the data plan charge and the $2.99 Administrative and Regulatory Fee, is collected at checkout along with the device hold and any optional add-ons. Subsequent monthly charges are billed in advance on a recurring basis. Current plan pricing is available on our website.

Device Hold

A refundable $99.99 device hold is collected at the time of purchase. The device remains the property of GotW3. When you cancel service and return the device with all original parts and packaging in good condition, the device hold will be refunded to you.

Protection Plan

An optional Protection Plan is available for a one-time fee of $39.99. The Protection Plan covers device damage or defects for two years from the date of purchase. If your device needs replacement, you will receive a new device and SIM card for a $30 claim fee.

Payment

All charges are billed in advance on a recurring monthly basis. You authorize GotW3 to charge your payment method on file for all applicable fees. If payment fails, your service may be suspended until the balance is resolved.

4. 14-Day Trial Period

GotW3 offers a 14-day trial period beginning on the date your device is delivered. During the trial period, you may cancel and receive a refund of the full subscription amount and device hold. The following are non-refundable: any activation fee, the $2.99 Regulatory Fee, shipping charges, and applicable taxes.

To initiate a trial cancellation, you must call our Support Center at 1 (833) 484-6893 within the 14-day window. The device and all original parts must be returned in their original packaging and in good condition.

5. Cancellation

You may cancel your GotW3 service at any time with no penalty or early termination fee. Service will remain active until your next billing date.

You MUST CALL our Support Center at 1 (833) 484-6893 to cancel your service. Upon completion of the call, you will receive emailed confirmation of your cancellation. For security purposes, we will not cancel service unless we speak with the account owner, or we receive legal confirmation that the account owner is not able to present themselves.

Upon cancellation, please return the device with all original parts and packaging. Your device hold refund will be issued upon receipt of the returned equipment in good condition.

6. Equipment

GotW3 devices remain the property of GotW3. You are responsible for the care and safekeeping of any device provided to you. You agree not to tamper with, modify, disassemble, or reverse-engineer any GotW3 equipment. Damaged, lost, or unreturned devices may result in forfeiture of your device hold.

7. Acceptable Use

You agree not to use GotW3 services to:

  • Violate any applicable law, regulation, or third-party rights
  • Transmit malware, viruses, or other malicious code
  • Conduct denial-of-service attacks or interfere with network infrastructure
  • Engage in spamming, phishing, or other fraudulent activity
  • Use automated systems, bots, or scripts that consume unreasonable amounts of network capacity
  • Resell, redistribute, or commercially exploit the service without written authorization
  • Engage in any activity that degrades network quality for other customers

8. Network Management

GotW3 reserves the right to manage our network to protect the experience of all customers. This may include:

  • Deprioritizing data speeds for customers identified as excessive users during periods of network congestion
  • Suspending or reducing download speeds if a customer exceeds their purchased data limit or violates the Fair Use Policy
  • Blocking or filtering traffic identified as malicious or harmful to the network

These practices are applied in a content-neutral manner and are not based on the type of lawful content being accessed.

9. Service Availability and Disclaimers

GotW3 services are provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law:

  • We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We are not liable for service interruptions caused by network outages, natural disasters, equipment failure, or other events beyond our reasonable control.
  • We are not responsible for the content accessed through our service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, GotW3 and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of or inability to use our services.

Our total aggregate liability for any claims arising under or related to these Terms shall not exceed the amounts you have paid to GotW3 in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless GotW3 and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services, your violation of these Terms, or your violation of any third-party rights.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of GotW3 services shall first be resolved through good-faith negotiation. If a dispute cannot be resolved informally within sixty (60) days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which RevGen Networks LLC is organized, without regard to its conflict of law provisions.

14. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will provide at least fourteen (14) days' notice by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after the effective date of updated Terms constitutes acceptance of those changes.
